What you need to know when booking our VIP Orlando Villa, at Magic Landings, Kissimmee

Please ensure you read and understand the following Terms and Conditions. If you have any queries, please do not hesitate to contact us (hereafter called The Owner) for clarification before you submit the Booking Form.

Whilst prices may increase or decrease we will confirm the price at the time of booking. Once your booking is confirmed and deposit paid, the COST OF THE RENTAL IS GUARANTEED against any further increase. This guarantee is offered subject to our Terms and Conditions and payment terms being adhered to, and that no amendments are made to your rental dates.

An initial reservation may be made by telephone, post, fax, on-line Booking Form or e-mail. It will be held for 7 days pending the return of the completed Booking Form and initial deposit.

Note: THE COST OF THE VILLA IS PER WEEK NOT PER PERSON.

BOOKINGS

The submission on-line or printing, signing and returning of the Booking Form and payment of the deposit by the party leader confirms acceptance of the Terms and Conditions set out below and shall be binding on the person(s) booking and intending to occupy the premises.

The Booking Form must be completed by the designated party leader (hereafter known as The Guest), who must be over 21 years of age. The Guest shall be deemed to be signing on behalf of all members of the party, who agree to be bound by these Booking Conditions.

To ensure comfort, security and compliance with the Licensing Legislation, only persons named on the Booking Form may occupy the villa, and any persons not shown on the Booking Form (without prior approval of the Owner) will be asked to leave.

PAYMENT

Payment can be made by bank transfer, cheque, all major credit cards or PAYPAL. On clearance of the final payment, VIP Orlando Villas will send you your receipt plus final instructions and information about the villa.

A deposit of £150 or $250 must be sent at the time of the provisional booking in order to secure that booking.

The balance is due 8 weeks prior to arrival. (In the event that the booking is made less than 8 weeks before arrival, the full payment is due at the time of booking). In the event of full payment not being made by the due time the Owner reserves the right to cancel the booking. Any deposits will be forfeited and the Guest will be required to pay cancellation charges in accordance with these Terms and Conditions — See Cancellation Charges below.

SECURITY DEPOSIT

In addition to the final payment a refundable security deposit of £150 or $250 is also required. The Security Deposit will be returned to you within 30 days of your departure from the villa, minus any costs incurred for breakages, damages or any other additional charges. Typical items which incur extra costs are (but not limited to): accidental damage, excess cleaning, long distance telephone calls and loss or non return of keys.

The Guest is held responsible for any damage or breakages that may be caused to the property and its contents, and also for all items in the Inventory during your stay. It is in the Guest's interest to check for any damage on arrival and report it to the Management Company as soon as possible. Similarly, any breakages or damage must be reported to the Management Company as soon as possible or prior to the time you vacate the property.

The Owner or Management Company reserve the right to retain the security deposit (either in part or in full) to cover breakages, damage or missing items. Receipts for repairs/replacements will be provided in the unlikely event that such retention of the security deposit is required.

CANCELLATION MADE BY THE GUEST

Notice of cancellation by the Guest must be made either by post or e-mail and receipt of such confirmed by the Owner, and will become effective from the delivery date confirmed by Owner. The deposit will be retained as part payment of the total amount due. All cancellations are subject to a charge payable by the Guest as detailed below:

8 weeks or more before departure - Deposit only
4 - 8 weeks before departure - 50% of rental cost
Less than 4 weeks before departure - 100% of rental cost

Should the Owner successfully re-let a Guest’s cancelled accommodation, the Owner may refund any fees already paid by the Guest minus the Deposit and any discount given to the new Guest to secure a late booking.

CHANGES TO BOOKING BY GUEST

Changes to the Booking can only be accepted from the Guest (the person that signs the Booking Form). The Owner will endeavour to facilitate any changes requested after the Booking has been confirmed. Changes may incur a small fee. The alteration will be effective when the Owner sends confirmation to the Guest, either by mail, fax or e-mail.

CHANGES OR CANCELLATIONS BY THE OWNER

Should circumstances beyond the Owner’s control make the villa unavailable, then the Guest will be advised as soon as possible. Alternative accommodation of at least comparable standard will be offered if available, or a refund of monies paid, unless the change or cancellation arises from reason of Force Majeure detailed within this Contract.

OCCUPANCY

Smoking is NOT permitted in the villa at any time. However smoking is permitted on the covered patio/lanai area. Please use the ashtrays provided. Any evidence of smoking within the villa will result in extra costs to the Guest for upholstery and carpet cleaning.

No pets are allowed in the villa. Contravention of this will incur extra cost to the Guest for extra cleaning of the carpets and upholstery.

No single sex parties will be accepted without prior approval of the Owner.

Whilst in residence, reasonable access should be given to the Management Agents, or service personnel in the event of necessary repairs.

The villa is available after 4.00 p.m. on the day of arrival and must be vacated by 10.00 a.m. on the day of departure. It may be possible to alter these times, but it must be arranged and confirmed with the Owner before occupancy. Failure to vacate the villa by 10.00 a.m. on the day of departure may result in a late occupancy charge.

Long Distance or International Calls can only be made using Tel3 Advantage. A total of 60 minutes worth of complimentary long distance and International calls to land lines are allowed for each booking. Instructions on how to use this service will be provided before arrival. Calls made over and above the 60 minutes complimentary allowance will incur a charge of $0.25 per minute. In addition, all Calls made to UK "Mobile Phones" will be charged at $0.25 per minute. This complimentary service can be withdrawn without notice and without compensation. If you do not use this complimentary service no refund for "unused" minutes will be given. Local calls are unlimited and free of charge.

Games Room – Children must be supervised in the games room at all times by an adult. Drinks or food are NOT to be placed on either the pool (billiards) table or the foosball table, please use the tables provided. Smoking is NOT permitted in the games room or any other areas inside the villa. No responsibility is accepted by the owner for any injuries to guests.

LIABILITY

The Owners and the Management Company accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings howsoever caused. The use of the all accommodations and amenities including the pool is entirely at the Guest’s own risk.

Please observe the pool safety notice displayed in the pool area. It is the responsibility of the adult members of the party to ensure that children are properly supervised at all times, especially whilst in the pool and decking area or games room.

PLEASE NOTE THAT IT IS AN OFFENCE UNDER FLORIDA LAW TO TAMPER WITH OR DISCONNECT THE INSTALLED POOL ALARMS.

Glass and crockery are not permitted within the pool area. Separate plastic utensils are provided for use in the pool area.

The information and descriptions supplied here are accurate and in good faith. In the event of any sudden failure of villa equipment the Owner or Management Company will take immediate reasonable action to rectify such a failure upon notification by the Guest. Certain features or facilities may not be available from time to time due to circumstances beyond the Owners control and therefore the Owner cannot accept responsibility.

The pool is cleaned and chemically balanced on a regular basis (usually weekly) for your safety and comfort; however on rare occasions it may be necessary to apply extra chemicals to the pool to maintain safe and correct chemical levels. Should this occur during your stay it will be necessary for you to be out of the pool for a period of 12-24 hours for your own safety.

The Owners and Management Company cannot accept liability for any loss of rental time due to travel problems, flight delays or cancellations, or any events outside of our control.

PASSPORTS AND VISAS

It is the responsibility of the Guest and guests to ensure that all those travelling in the party have complied fully with all passport and visa requirements in place at the time of travel. Any failure in respect of this may result in your travel arrangements being amended or cancelled with consequential losses in respect of your villa booking. In such circumstances no liability attaches itself to the Owner.

TRAVEL AND MEDICAL INSURANCE

We strongly recommend that you ensure you have adequate Travel and Medical Insurance for the duration of your stay, to cover eventualities such as cancellation, accident, sickness or damage to luggage etc. The Owner is not responsible for Guests and members of your party who do not carry adequate insurance to cover unforeseen cancellation of your holiday, or cause additional expense to be incurred by you or members of your party.

COMPLAINTS OR DISSATISFACTION

We sincerely hope you do not have any complaints, but in the unlikely event of any problems with your villa during your rental period, you must inform the Management Company immediately and the Owner as soon as possible. The Management Company or Owner will then do everything realistically possible to rectify the problem. If the matter is not resolved, the Guest must follow up the complaint in writing to the Owner within 14 days of the end of your rental period.

RESPONSIBILITIES

All persons stated on the Booking Form are responsible for the care of the property and are expected to take reasonable care, including locking doors. All utensils, carpets, furnishing and fittings must be left clean and tidy. It is the Guests responsibility to notify the Management Company immediately of any breakages, spillages or equipment failure so that reasonable action can be taken to rectify the situation.

The Guest agrees to pay the full cost of any breakages, loss or damage to the property and it’s fixtures and fittings. The Management Company will be sole arbitrators on the cause of damage or loss.

It is the Guests responsibility to ensure that the pool and spa are covered when not in use during their stay (especially overnight) by the thermal blankets provided. The Owner has agreed to provide free pool heat solely on the condition that the pool and spa are covered by these blankets when not in use. Failure to do so will render the Guests liable to the daily charge for heating the pool for the duration of their stay - currently $25 per day.

Please note that a fine may be levied by the Local Council if dustbins are left outside for an unreasonable amount of time after they have been emptied. It is therefore within the Guest’s interest to ensure all bins are returned to their rightful place within a reasonable time after they have been emptied, as the Guest will be responsible for any fines incurred.

Florida has a sub-tropical climate and care must be taken that food is not left out uncovered. Apart from contaminating areas, it can very quickly attract insects. Any costs incurred for additional pest control and/or cleaning may be passed onto the Guest if it is found that due care had not been taken.

CODE OF CONDUCT

It is a condition of rental that you should be considerate in your behaviour for the comfort and enjoyment of other villa owners/renters. Please do not use the swimming pool, play loud music or engage in any activity which would cause a disturbance to your neighbours, between the hours of 10.30 p.m. and 07.30 a.m. In the event that any member of your party behaves in a way that is likely to cause distress, danger, damage to property or cause annoyance to other holiday makers or residents, the Owners or their Management Company reserve the right to terminate your rental agreement immediately. The Owners or Management Company will not be liable for any costs you may incur, nor shall we pay any compensation or refunds due to this action.

FORCE MAJEURE

There may be circumstances completely beyond the control of either the Owner or Management Company that may result in the property not being available for your booking. These events include, but are not limited to: destruction or severe damage to the property, industrial dispute, natural disaster, fire, adverse weather or health and safety issues.

In the event of the above the Owners or Management Company will do their best to make alternative arrangements for you and your party. If alternative arrangements are not acceptable to you, then a full refund of all monies will be paid. This will be the full extent of the Owner’s liability to you. The Owners will not be responsible for any costs other than the villa rental itself.

JURISDICTION

Completion of the Booking Form constitutes acceptance of a Contract on these terms subject to both Florida State Law and English Law and the jurisdiction of the English Courts.
